1. Organizer

The organizer of the Isle of Summer event series is Life is Good GmbH, represented by its managing director, located at Reichenbachstraße 33, 80469 Munich (hereinafter “Organizer”)

2. Scope of the General Terms and Conditions

a) These General Terms and Conditions (hereinafter “GTC”) apply between the ticket purchaser and the event organizer and/or the visitor and the event organizer. By purchasing a ticket, the ticket purchaser and the visitor (hereinafter “Customer”) enter into an event contract with the event organizer.

b) By purchasing a ticket or entering the festival grounds, each customer and visitor acknowledges the rights and obligations set forth in these Terms and Conditions.

c) The Isle of Summer event series takes place in designated festival areas. The festival grounds include the actual event site and the parking areas.

3. Conclusion of the Contract

a) A ticket request on the website does not constitute an offer to enter into a contract, but merely an invitation to the customer to submit an offer. The offer to conclude the contract originates from the customer and is made by entering all relevant data into the order form and electronically transmitting it to the respective ticket sales agent (including Eventbrite, Eventim, and other ticket sales agents). A final contract with the customer is only concluded upon transmission of an order confirmation and issuance of an invoice by the ticket sales agent.

b) Orders may only be placed by customers who are of legal age and have full legal capacity.

c) Tickets may not be returned under any circumstances. Likewise, there is no right of withdrawal for online orders pursuant to Section 312g(2)(9) of the German Civil Code (BGB).

4. Transfer of tickets

(a) The transfer or sale of tickets and the associated transfer of the right to attend to a third party is generally permitted, unless

(aa) that the third party is barred from the premises and that the customer was aware of this fact or should have been aware of it

(bb) the ticket is offered at a price higher than its face value

cc) the sale is for commercial purposes.

(dd) the ticket is personalized or non-transferable

(ee) the sale is arranged by unauthorized third parties, in particular internet service providers; carried out by unauthorized third parties; or processed by unauthorized third parties, in particular by online marketplaces and ticket resellers not authorized by the organizer (e.g., eBay).

(ff) the transfer is directly or indirectly related to advertising campaigns, unauthorized travel packages, bonus offers, or sweepstakes.

b) If the organizer determines that the customer has violated one or more of the provisions under a), the organizer may block the relevant tickets and deny the customer/ticket holder access to the festival grounds without compensation or remove them from the grounds, refuse to sell any type of tickets to the customer in the future, issue a ban from the premises, and demand payment of a reasonable contractual penalty of up to a maximum of EUR 2,500.00 for each violation of 4 a). The exact amount of the contractual penalty shall be determined by the organizer on a case-by-case basis at its reasonable discretion and, in the event of a dispute, shall be reviewed for reasonableness by the competent court. The contractual penalty shall be offset against any claims for damages by the organizer arising from the violation. In such a case, the organizer reserves the right to report the incident in an appropriate manner, including the customer’s name, in order to prevent any future use of the tickets in breach of the contract.

c) No replacement will be issued if the ticket is lost.

5. Entry to the event grounds

a) Admission to the event grounds is permitted only with a valid ticket. The ticket entitles the holder to a single entry to the event grounds and is valid for one person only. Re-entry after leaving the event grounds is expressly prohibited (with the exception of weekend tickets).

b) Upon entering the festival grounds, security personnel will conduct a security check. The personnel are instructed to conduct body and bag searches of visitors, particularly upon entry to the event grounds. Visitors agree to this

c) The organizer reserves the right to deny individual visitors entry to the festival grounds for good cause. Good cause includes, in particular,

(aa) carrying prohibited items (as specified in paragraph 6)

(bb) a visitor who is clearly heavily intoxicated by alcohol or narcotics

cc) any overtly homophobic, sexist, racist, or inhumane attitude on the part of the visitor.

(dd) a violation or deliberate circumvention of regulations protecting minors by the visitor or accompanying persons

d) If there is a valid reason for denying entry as described above, the admission ticket or festival wristband will become invalid, and the admission fee will not be refunded.
e) There is sufficient space for all festival attendees in front of the outdoor stages on the event grounds. Access to the stages, VIP areas, tents, and indoor stages is restricted and already limited due to official regulations. The organizer is entitled to block access to these areas, in whole or in part, temporarily or permanently, once capacity limits are reached. Furthermore, there is no right to re-entry once these areas within the event grounds have been left. Arriving on time is therefore strongly recommended. Instructions from security staff must be followed.

6. Prohibited Items

a) Throughout the entire festival grounds, the following items are prohibited: glass bottles of any kind, other glass containers, animals, weapons of any kind (including technical weapons), torches, pyrotechnic devices, dry ice, sparklers, sky lanterns, drones (as well as their remote control over the grounds), vuvuzelas, megaphones, commercial, political, or religious items of any kind, including banners, signs, symbols, or flyers, as well as dangerous items of any kind.

b) You must follow the instructions of the staff. The organizer reserves the right to immediately remove anyone from the event grounds for failure to comply.

(c) The organizer is also entitled to temporarily hold and take possession of prohibited items.

7. House Rules / Code of Conduct / Photography and Filming

a) The organizer or its staff (including security personnel) shall enforce the house rules. The house rules and festival grounds regulations apply on the festival grounds. Visitors must strictly comply with the instructions of the organizer’s staff. Among other things, visitors are prohibited from doing the following on the festival grounds:

(aa) carrying prohibited items,

(bb) to use physical force against other visitors, the organizer’s staff, or other third parties,

cc) Throwing objects onto the stage or at other audience members,

(dd) urinating or defecating outside of restrooms,

(ee) damaging, painting, spray-painting, or defacing buildings, walls, property, etc.,

(ee) to engage in commercial activities, advertising, or marketing campaigns without the prior written consent of the organizer.

(ff) Entering areas and rooms that are not open to the general public, or climbing onto stages, tents, trusses, or similar structures.

b) Taking photos and videos using smartphones or digital cameras (not professional equipment) for personal use is permitted. The personal rights of third parties must be respected at all times. Any other form of film or audio recording of any kind, as well as their publication online or offline, is prohibited without the organizer’s permission.

c) Visitors who violate the above rules of conduct may be removed from the festival grounds by the organizer or its staff and may be barred from the premises.
d) If there is a valid reason as described above and the organizer removes the visitor from the venue, the ticket or festival wristband will become invalid. In this case, the admission fee will not be refunded.

8. Event Cancellation / Event Interruption / Event Schedule

a) If an Isle of Summer event is canceled before it begins, you are entitled to a refund of the ticket price, excluding the advance booking fee and system fee.

b) Isle of Summer Events will take place regardless of weather conditions. However, if weather conditions pose a risk to the life, limb, or health of visitors, artists, or staff, the festival will be canceled immediately. In this case, as well as in the event of cancellation of the festival already in progress for other reasons of force majeure, in particular due to an official order or court decision, there shall be no claim for a refund or damages, unless the organizer can be charged with intent or gross negligence.

c) Liability for consequential damages resulting from the postponement or cancellation of the event is excluded.

(d) The organizer has no influence whatsoever on the format, duration, or content of the individual performances and therefore assumes no liability to the visitor in this regard.

e) The ticket entitles the holder to a single entry to the festival grounds. In the event of program changes, the cancellation of individual shows or performances, or concerts by individual artists—including so-called headliners—the visitor shall have no claims against the organizer, provided that such changes remain within reasonable limits and the overall character of the festival is preserved.

f) Delays and changes to individual program items are possible. The organizer will announce any changes immediately online on the event website or in the festival app.

9. Health Effects of Noise

a) The visitor is aware that at Isle of Summer events, particularly in front of the stages, sound levels are exceptionally high and there is a risk of potential health damage, particularly hearing loss. The organizer strives to ensure that visitors are not harmed by the sound level through the use of appropriate technical equipment, volume limits, and the selection of specific event locations. However, regardless of these measures, it is strongly recommended that visitors use earplugs, especially when standing near the loudspeakers.

b) Visitors should adjust their location in front of or on the respective stages, as well as the length of time they spend there, to suit their individual listening preferences and the associated comfort level.

10. Protection of Minors

a) The general provisions of the Law on the Protection of Minors in Public apply to every event.

b) Admission for ages 18 and older (Section 1(1)(4) of the Youth Protection Act).

11. Limitation of Liability

a) Within the scope of this contract, the Organizer shall be liable, in cases of statutory or contractual liability, for compensation for damages or for reimbursement of futile expenses caused by the Organizer, its legal representatives, or vicarious agents, in cases of willful misconduct or gross negligence. In the event of a slightly negligent breach of a primary obligation or an ancillary obligation, the breach of which jeopardizes the achievement of the purpose of the contract or the fulfillment of which is essential for the proper performance of the contract and on the observance of which the customer was entitled to rely (hereinafter “material ancillary obligation”), the Organizer’s liability is limited to damages typical for this type of contract and foreseeable at the time of conclusion of the contract. The organizer is not liable for the slightly negligent breach of contractual ancillary obligations that do not constitute essential ancillary obligations.

b) Claims arising from the culpable causing of injury to life, limb, or health, under the Product Liability Act, due to fraudulent misrepresentation, or based on a warranty regarding quality provided by the organizer or a procurement risk assumed by the organizer remain unaffected.

(c) The limitation of liability also applies to the personal liability of the organizer’s legal representatives and agents.

d) The organizer is not liable for lost or damaged items. Parking in designated parking spaces or on the campground is at your own risk.

12. Audio and Video Recordings

(1) During the event, the organizer, as well as photographers, film crews, agencies, and other service providers commissioned by the organizer, will take photographs and make video and audio recordings. Visitors will be informed of this before and during the event, particularly during the ticketing process, in the event terms and conditions, and through notices posted at the event venue.

(2) The recordings are used for reporting on the event, documentation, public relations, and the promotion of the event and future similar events organized by the organizer. For these purposes, they may be published and distributed in particular on the organizer’s websites, in newsletters, press releases, aftermovies, and on the organizer’s social media channels, specifically Instagram, Facebook, TikTok, YouTube, and LinkedIn. This also includes Stories, Reels, short videos, and other formats common to these platforms.

(3) The use of such images generally takes the form of overview shots, stage shots, atmospheric shots, audience shots, and event shots in which individual visitors are not specifically highlighted as the main subject. The processing of personal data is based on Article 6(1)(f) of the GDPR. The organizer’s legitimate interest lies in the documentation, public presentation, follow-up reporting, and promotion of the event as well as future comparable events. The admissibility under image rights law is governed by statutory provisions, in particular Sections 22 and 23 of the German Artistic Copyright Act (KUG).

(4) If a visitor enters the event grounds or remains in designated photo and video areas after becoming aware of these notices, this may—depending on the circumstances of the individual case—constitute implied consent to the taking and use of such recordings for the purposes set forth above, provided that no overriding legitimate interests of the visitor preclude such consent.

(5) The prominent use of individual visitors for advertising purposes, where the person in question is clearly the focus of the image—particularly for advertisements, paid social ads, posters, personalized advertising materials, campaign materials, or other specially highlighted advertising measures—shall only take place on the basis of separate consent, unless statutory permission applies in a specific case.

(6) The organizer shall ensure that the legitimate interests of visitors are protected. In particular, no images shall be published that unduly highlight, disparage, or distort individual visitors, portray them in an inappropriate or particularly sensitive context, or violate their legitimate privacy interests.

(7) Visitors may object to the creation and use of recordings in which they are recognizably depicted for reasons arising from their specific circumstances. The objection may be raised during the event to the organizer on-site or subsequently in writing, in particular by email to [email address]. The organizer will review valid objections and, within the scope of legal and technical possibilities, remove, blur, or refrain from future use of the affected content.

(8) Visitors’ legal rights, in particular those arising from the right to one’s own image, general personality rights, and the General Data Protection Regulation, remain unaffected. 14. Governing Law / Severability Clause / Miscellaneous

a) This Agreement is governed exclusively by German law.

b) The organizer reserves the right to amend the Terms and Conditions at any time

(c) If any provision of these Terms is or becomes invalid or unenforceable, this shall not affect the validity of the remaining provisions. Such a provision that most closely approximates the intended purpose in a legally valid manner shall replace the invalid or unenforceable provision. The same applies in the event of any gaps in these Terms.

(d) Please note that the organizer is neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.

15. Parking spaces

Parking is permitted in the parking spaces designated by Life is Good GmbH. A fee is charged for each vehicle parked in these areas to cover personnel costs, restoration expenses, and rent.
